1. Who we are

GemID (the "App") and the website gemidentify.app (together, the "Service") are operated by Tech With You, a company organized under the laws of the State of Delaware, USA ("we", "us", "our").

This policy explains what personal information we collect, how we use and share it, and the choices and rights you have. Questions: support@gemidentify.app.

2. Information we collect

Information you give us:

  • Account details: your name and email address, or the identifiers Apple or Google provide when you sign in with them.
  • Photos you take or upload for a scan, and the results we generate for them.
  • Collection details you choose to add: titles, notes, where you acquired a piece, purchase price and date, wishlist status, certificate details and certificate files.
  • Your choices in Settings: language, photo retention period, notification preferences, and whether you opt in to model training or marketing messages.
  • Messages you send to support.

Information collected automatically:

  • Device and app information: device model, operating system, app version, language and time zone.
  • Push notification tokens, if you allow notifications.
  • Purchase records from Apple or Google: product, transaction identifiers and subscription status. We never receive your card or payment details.
  • Technical logs: IP address, request times and error reports, used to run and secure the Service.

Website: gemidentify.app does not use advertising or analytics cookies. Pages load fonts from Google Fonts, so your browser sends your IP address to Google when you visit. Our hosting provider keeps standard access logs.

We do not collect precise location, contacts, or advertising identifiers, and we do not track you across other apps or websites.

3. How we use information

  • To provide the Service: create your account, analyze your photos, show results, and store your scans and collection.
  • To process in-app purchases and enforce scan allowances, including your 100 free scans.
  • To send notifications you have allowed, such as when a result is ready.
  • To send tips and news only if you opt in; you can opt out at any time in Settings.
  • To provide support, keep the Service secure, prevent abuse and fraud, and fix problems.
  • To comply with law and enforce our Terms of Use.
  • To improve our identification models only if you separately opt in to "Help improve GemID". This is off by default and you can withdraw at any time.

4. AI analysis of your photos

To identify possible matches, we send your scan photos to our AI service provider (currently OpenAI) through its API. The provider processes them only to return results to us. We use the API with response storage turned off, and under the provider's API terms your photos are not used to train its models.

Results are possible matches generated by a computer model. They are not a gemological certificate, appraisal or authentication. See our Terms of Use.

5. Legal bases (EEA, UK and similar laws)

  • Contract: to provide the Service you signed up for.
  • Legitimate interests: to secure, maintain and improve the Service and respond to support requests, balanced against your rights.
  • Consent: for model training, marketing messages and notifications. You can withdraw consent at any time.
  • Legal obligation: to keep records required by law, such as purchase and tax records.

6. How we share information

We do not sell your personal information or share it for cross-context behavioral advertising. We share it only with:

  • Service providers that process data on our behalf: Amazon Web Services (hosting and storage), OpenAI (photo analysis), Google Firebase (Android push notifications), Apple and Google (sign-in, in-app purchases and push delivery), and Cloudflare (domain and email routing).
  • Authorities, when required by law or to protect the rights, safety and property of our users, the public or us.
  • A successor, if we are involved in a merger, acquisition or sale of assets, subject to this policy.

7. International transfers

We are based in the United States and our providers may process data in the United States and other countries. Where required, we rely on appropriate safeguards such as the European Commission's Standard Contractual Clauses.

8. How long we keep information

  • Account and collection data: until you delete them or your account.
  • Scan photos: for the period you choose in Settings (until deleted, 30 days, 90 days or 1 year). Results and notes stay unless you delete them.
  • After you delete your account, we delete your data within 30 days, except encrypted backups, which expire within a further 35 days, and records we must keep by law.
  • Purchase records: as long as required for tax and accounting purposes.

9. Your rights and choices

Depending on where you live, you may have the right to access, correct, delete or export your personal information, to object to or restrict certain processing, and to withdraw consent. You can do most of this in the App: edit your details, export your data, change retention and consent settings, or delete your account in Settings. You can also email us.

California and other US state residents: you have the right to know what personal information we collect and how we use it, to delete and correct it, and to opt out of its sale or sharing (we do not sell or share it). We will not discriminate against you for exercising your rights. You may use an authorized agent; we may need to verify your identity.

If you are in the EEA or UK, you may also complain to your local data protection authority.

10. Security

Photos and certificate files are stored privately and are only accessible through short-lived, signed links. Data is encrypted in transit, and we restrict access to people and systems that need it. No method of transmission or storage is completely secure.

11. Age requirement

The Service is intended for people aged 18 and over. We do not knowingly collect information from anyone under 18. If you believe a minor has given us information, contact us and we will delete it.

12. Changes to this policy

We may update this policy. If changes are significant, we will notify you in the App or by email before they take effect. The date at the top shows the latest version.
